48-Hour Rule May Not Guarantee Shatta Wale’s Release – Security Consultant


Security and Fraud Consultant, Richard Kumadoe, says the constitutional 48-hour rule may not necessarily secure the release of dancehall artiste Shatta Wale, who is currently in the custody of the Economic and Organised Crime Office (EOCO).


According to him, EOCO has the legal option of applying to the courts for additional time if investigators believe the musician has more questions to answer.


“Ordinarily, the law requires that within 48 hours, the suspect should either be released or arraigned. But if EOCO convinces the court that they need him for further questioning, then detention can be extended. They may also impose bail conditions which, if unmet, can keep him in custody beyond 48 hours,” he explained.

The 48-hour rule, enshrined in Article 14(3) of Ghana’s 1992 Constitution, protects citizens from unlawful detention by requiring that suspects be brought before a court within two days. However, Kumadoe stressed that this safeguard does not eliminate the possibility of extended detention if justified before a judge.


He further cautioned that Shatta Wale’s case might extend beyond the luxury vehicle currently under probe. Speaking on Yɛn Nsempa on Onua FM, the consultant urged the artiste to exercise restraint and avoid impulsive comments on social media.


“When EOCO says they are investigating a car, you can’t assume that is all. For all you know, the Lamborghini is just their entry point,” he said.

Outlining basic principles for anyone facing investigation, Kumadoe advised:

  1. Do not dictate to investigators.

  2. Avoid erratic or suspicious behaviour.

  3. Remain silent to avoid self-incrimination.


The case has generated intense public interest, with many awaiting EOCO’s next move in the coming days.
