High Court rejects bid to pause Adu-Boahene trial pending appeal

The Accra High Court has dismissed an application by lawyers for former National Signals Bureau (NSB) Director-General, Kwabena Adu-Boahene, seeking to suspend his ongoing criminal trial while an appeal on an earlier ruling is determined.


The defence had asked the court to stay proceedings pending the outcome of their appeal against a previous decision that denied them access to certain disclosure documents they claim are essential to their client’s defence.


In its ruling on Friday, October 17, 2025, the court refused the request, meaning that the trial will continue even as the appeal is heard. The decision confirms that the filing of an appeal does not automatically halt prosecution proceedings.


Why the defence sought the stay

Lead counsel Samuel Atta-Akyea argued that the documents in question were material and exculpatory, and that proceeding without them would deny the accused a fair trial. The defence therefore urged the court to pause the case until the appeal is resolved.


Prosecution’s response

Deputy Attorney-General Dr. Justice Srem-Sai, representing the state, opposed the application, arguing that the defence had not demonstrated any exceptional circumstances to justify suspending the trial.

He further contended that the disputed documents were either irrelevant or not in the possession of the prosecution, a position that formed the basis of the earlier ruling against additional disclosure.


Key development in the case

Earlier this week, in a related move, Attorney-General Dr. Dominic Ayine withdrew charges against Mildred Donkor, the third accused, under Section 59 of the Criminal and Other Offences (Procedure) Act, 1960 (Act 30), allowing her to serve as a prosecution witness.


A notice filed at the High Court on October 15 confirmed that Ms. Donkor will testify about transactions and her relationship with Adu-Boahene and his co-accused — a development expected to bolster the prosecution’s case in upcoming hearings.


Background of the case

Kwabena Adu-Boahene and three others — Angela Adjei Boateng (his wife), Advantage Solutions Limited, and previously Mildred Donkor — are facing multiple charges, including stealing, money laundering (involving an alleged GH¢49.1 million), willfully causing financial loss to the state, and abuse of public office.


The prosecution alleges that large sums of money were diverted from state accounts into private entities, with Advantage Solutions Limited allegedly serving as a conduit for the transactions.


With the application for a stay now rejected, the criminal trial will proceed as scheduled while the appeal runs its course.
