Court Adjourns Hearing of Akosua Serwaa’s Injunction on Daddy Lumba’s Funeral to October 28


The Kumasi High Court 5, presided over by Her Ladyship Justice Dorinda Smith Arthur, has adjourned to October 28 the hearing of an injunction application filed by Akosua Serwaa, who is seeking legal recognition as the only surviving spouse of the late highlife legend, Charles Kwadwo Fosu, popularly known as Daddy Lumba.


In her suit, Akosua Serwaa is asking the court to declare her the lawful and surviving spouse of the late musician and to affirm her exclusive right to perform widowhood rites.


She is also requesting the court to restrain the head of the Lumba family, Kofi Owusu Fosu, from recognising or associating with the second defendant, Priscilla Ofori Atta (also known as Odo Broni), as a spouse of the deceased. Additionally, she wants Odo Broni barred from publicly presenting herself as Daddy Lumba’s surviving wife.

During Thursday’s proceedings, counsel for the first defendant challenged Akosua Serwaa’s legal capacity, asking the court to determine that issue before moving forward with the case. Justice Dorinda Smith Arthur also noted that both sides had filed appearance applications and directed all lawyers to submit their responses and motions by October 28.


In her closing remarks, the presiding judge urged both parties and their families to pursue an amicable settlement, citing Daddy Lumba’s immense contribution to Ghana’s music industry and his enduring legacy.


The case, which has drawn significant public and media attention, is expected to continue later this month for further deliberations.
