I Want To Go The High Court – ACP Agbordzor Petitions AG

Lawyers for the alleged suspect, ACP Dr. Benjamin Agbordzor, Martin Kpebu has petitioned the office of the Minister of Justice and Attorney General for infringement of rights by the Bureau of National Investigation (BNI).

‘In a deliberate attempt to infringe on his client’s constitutional rights, the BNI took him to the District court which do not have jurisdiction to hear the case of treason felony, which is a first-degree felony, the Lawyers explained.

The petition sighted by Kingdom News, copied to the Director of BNI and Minister of State in Charge of National Security states that ACP Agborzdor was invited by the BNI on 4th November to help in investigations in alleged attempts to destabilize the Government.















ACP Dr. Agbordzor is being interrogated for contributing to a certain WhatsApp group which have lawyers, judges, and other respected Ghanaians, as well as donations he made as part of contributions towards philanthropic community outreach by a Non-Governmental Organization (NGO) to the Agbogbogbloshie Township, a deprived community in Accra.

He states further that he was subsequently detained over allegations of abetment of Treason, which he has denied but the BNI are trying all means to refuse him bail.

The petition to the Attorney General’s office continues that the District Court has no jurisdiction to try the offense for which ACP Dr. Agbordzor is being held by the BNI under Article 14(3) of the Constitution.

As the office of the Attorney Generals is aware, that the Supreme Court has held that the court before which the suspect is brought must be a court that has jurisdiction to try the offense for which the suspect is being held.

They are therefore calling on the Attorney General and Minister of Justice to draw the attention of the Bureau of National Investigations (BNI) to take ACP DR Benjamin Agborbzor to the High Court as it is the only court that has jurisdiction to grant bail and also remand him.
